If you are the spouse, parent, or unmarried child under 21 of a U.S. citizen, you may be eligible to become a lawful permanent resident from within the United States.

General Eligibility

Who qualifies?

Adjustment of Status may be available to the following immediate relatives of a U.S. citizen:

  • Spouse

  • Parent (if the U.S. citizen is at least 21 years old)

  • Unmarried child under 21 years of age

 

Other general requirements include:

  • Being physically present in the United States

  • Entering the United States with inspection

  • Not being barred from Adjustment of Status because of certain criminal or immigration violations* 

 

*Certain criminal convictions, prior immigration violations, fraud, multiple unlawful entries, or other grounds of inadmissibility may affect eligibility.

OTHER CONSIDERATIONS

Other family-based categories, including certain relatives of lawful permanent residents (green card holders), may also qualify for Adjustment of Status.Not the immediate relative of a U.S. citizen?

Unlike immediate relatives of U.S. citizens, additional waiting periods and eligibility requirements often apply.
