The Fiancé Visa (K-1 Visa) is the legal process by which a US citizen petitions for their foreign-national fiancé(e) to enter the United States for the purpose of getting married. Once in the US, the fiancé(e) must marry the US citizen within 90 days and may then apply for Adjustment of Status to become a lawful permanent resident
To be eligible for a Fiancé Visa, you must be:
-
The petitioner must be a US citizen (not a green card holder)
-
Both parties must be legally free to marry (divorced, widowed, or never married)
-
Both parties must have met in person at least once within the last 2 years

-
The couple must have a genuine intention to marry within 90 days of the fiancé(e)'s arrival in the US
-
The petitioner must meet minimum income requirements to financially support the fiancé(e)
-
Neither party may have any unresolved bars to admissibility
IMPORTANT. Please note that these are the most common eligibility requirements for the Fiancé Visa. There are many exceptions to these rules and other qualification criteria (e.g., waivers for the in-person meeting requirement in cases of extreme hardship or cultural customs). For this reason, it is important to talk to an immigration attorney to determine whether you are truly eligible for the Fiancé Visa.
